Terms of Service

In this agreement (“the Agreement”), the words “you” and “your” refer to the party utilizing the 4DS Marketing DBA MyHomeStory PRO (MHS PRO) materials and/or services.

The purpose of this Agreement is to provide proprietary marketing information obtained by MHS PRO from public documents and other sources (“List & Subscription Service”) for your lawful direct mail and telemarketing activities, within the scope of your professional operations.

Upon acceptance of this Agreement and full payment, MHS PRO grants you a limited, non-exclusive, non-transferable license for a single (monthly) use of the List & Subscription Service.

Subscriptions automatically renew at the end of each term. Companies can opt out by updating their subscription in the Portal.

Renewal Terms

Listings Subscription - Renewal and payment occur 30 days after initial purchase unless canceled in the “Subscriptions” tab.

Pricing

MHS PRO may change prices/fees with 7 days’ notice. Clients must cancel before price changes if they do not agree.

• Maintain confidentiality of all information received under the List & Subscription Service.
• Do not sell, lease, reproduce, store, or disclose information, in whole or in part, without written consent from MHS PRO.
• Do not reference MHS PRO or the List & Subscription Service in advertisements or marketing materials.
• Maintain security of login credentials, API keys, or access tokens; do not share with unauthorized parties.

If accessing MHS PRO data, products, or services via API or digital integration:

Permitted Use

Use the API solely for internal business purposes according to your subscription and documentation.

Prohibited Uses

• Sublicense, sell, transfer, or distribute API or data to third parties.
• Use API to provide data/services to third parties (e.g., SaaS or white-labeled products).
• Share API keys or credentials outside your organization.
• Circumvent subscription limits or fees.
• Store or reproduce data beyond your license term.
• Use API for benchmarking, competitive analysis, or developing competing products.

Monitoring and Enforcement

MHS PRO monitors API usage and may suspend or terminate access without refund if violations occur.

Ownership

All API rights, software, and documentation remain sole property of MHS PRO. No rights granted beyond those in this Agreement.

• No refunds for services once approved for delivery.
• MHS PRO may offer account credit or partial refunds if costs were incurred before approval.
• No refunds after 1 year from original charge.
• MHS PRO and its data suppliers are not liable for damages due to data unavailability, inaccuracies, or errors.
• You agree to indemnify MHS PRO and its representatives from any claims arising from your use of the List & Subscription Service.
• Compliance with applicable telemarketing, faxing, and emailing laws is your responsibility.

MHS PRO and its data suppliers do not guarantee data availability or accuracy.

No warranties, express or implied, including merchantability or fitness for a particular purpose.

• Governing Law: Georgia law, without regard to conflicts of law principles.
• Jurisdiction: Courts in Cobb County, Georgia.
• MHS PRO may assign rights or delegate duties; you may not transfer or assign without written consent.
• Entire agreement supersedes prior agreements, written or oral.
• Changes to the Agreement must be written and signed by both parties, though MHS PRO may revise its posting form unilaterally.
